Limited Conservatorships
Limited Conservatorships were created by the California Legislature. The purpose of a Limited Conservatorship is to ensure that developmentally disabled adults who are unable to provide for themselves are taken care of while allowing them to retain as many rights as possible.
1
Preparation of Documents
Limited Conservatorships can be completed without the use of an attorney. With this being said, the process of petitioning for a Limited Conservatorship requires the submission of numerous forms and documents, before and following a court hearing, and legally sufficient notification of the petition and hearing to multiple parties. Frequently, improperly completed filings result in continuances which delay finalizing the Limited Conservatorship.

I have experience guiding numerous families through the Limited Conservatorship petition process. I can assist in ensuring that the petition process moves along as efficiently as possible so that the developmentally disabled adult's rights are protected as quickly as possible.
2
Rights transferred as part of a Limited Conservatorship
Limited Conservatorships of the person transfer up to 7 rights from the developmentally disabled adult ( or conservatee) to a conservator or co-conservators. This transfer of rights removes the ability of a conservatee to make decisions regarding certain aspects of their life and transfers those decision making rights to the court appointed conservator or co-conservators. These rights are:

1) The Right to Contract
2) The Right to Access Confidential Documents
3) The Right to Marry or Enter into a Domestic Partnership
4) The Right to Decide Where the Conservatee Lives
5) The Right to Make Educational Decisions.
6) The Right to Make Medical Decisions
7) The Right to Select Social and Sexual Contacts

Legal Services Performed
I will gather all necessary information required to complete all documents required to complete the Limited Conservatorship Petition. I will also ensure that proper notice of the hearing is provided to all legally required parties. Finally, I will meet with you to prepare you for the hearing as well as accompany you to the hearing.

I provide these services for a fixed fee. Given this fact, I only provide representation on Limited Conservatorship Petitions that are not contested.
